A series of alleged dishonest moves by the Los Angeles Unified School District (LAUSD) in connection with a lawsuit filed by Health Freedom Defense Fund in 2021 has the litigants back in court.
The original suit was filed on behalf of staff and teachers who were suspended or fired after they refused to take experimental gene therapy COVID mRNA vaccinations mandated by the district. The case was dismissed when the school district rescinded its mandate, but refiled when the district reinstituted the mandate 17 days later.
Oral arguments in the Ninth Circuit Court of Appeals began in September 2023 and, according to the California Globe, the appeals judges said they not only were shocked and floored that the mandate and case were still dragging out, but that the lower court’s rationale “was clearly wrong.”
The Health Freedom Defense Fund is hoping the appeals court will send the case back to the district court, where it can proceed and allow the plaintiffs to fully present their case.
“It is high time for the Ninth Circuit, which has led the way in bodily autonomy jurisprudence, to allow the case to proceed so that the plaintiffs may prove their case — namely, that the Covid injections are nothing more than a therapeutic, that natural immunity is superior, that Jacobson does not apply, and that recent case law regarding bodily autonomy overrides the outdated Jacobson,” the Globe reported.
